Cannabis is allowed for medicinal use in the Netherlands. On September 1st 2003 the Office of Medicinal Cannabis started delivering cannabis with a medicinal grade to patients through pharmacies. Behind this process are different laws, nationally and internationally.

Internationally there is the Single Convention on Narcotic Drugs (1961). Article 28 of this Convention says that if a country allows the growth of Cannabis it has to do so under supervision of a government agency. In the Netherlands that agency is the Office of Medicinal Cannabis (OMC) which is a part of the Ministry of Health, Welfare and Sports.

On international level the International Narcotics Control Board (INCB) oversees all action of our agency.

On national level we have the Dutch Opium Act, which has been altered in March 2003. In the Netherlands growing cannabis is forbidden unless the company has a permit. In the Netherlands one grower has a permit to grow medicinal cannabis for pharmacies. It is legal for the OMC to deliver medicinal cannabis to pharmacies and for pharmacies to supply the medicinal cannabis to patients (on doctors prescription only). In addition standardized cannabis is available for scientific research and product development.

In October 2006 the highest Dutch court decided to not punish a patient, due to a situation of emergency,  which grew his own cannabis plants. This judgment was exceptional and only for this individual patient, so it doesn’t mean that patients are free to grow themselves.

Realties

The OMC is the official wholesaler in medicinal cannabis. Therefore they set up a whole production and distribution chain for now four varieties of cannabis: there is a contracted grower and a packaging and distribution company. To ensure that patients receive cannabis which is standardized and that is safe and qualitative good the OMC has slightly fitted in with the European Guideline for Good Agricultural Practice for Growth of cannabis for medicinal purposes. The grower that is contracted grows his cannabis according to this GAP-guideline.

All batches of medicinal cannabis which have been cultivated have to meet the quality requirements which BMC has defined. The OMC provides a quality system to ensure that the cannabis the patients receive is qualitative good and safe. For this purpose the OMC has contracted a GLP – certificated laboratory. A monograph is available which connects with the requirements of the Ph. Eur.

The medicinal cannabis is tested on contents of cannabinoids, content stability, humidity, microbiology, pesticides, heavy metals and aflatoxines. Every batch medicinal cannabis comes with his own release certificate with all relevant information. These are available through the website www.cannabisbureau.nl. 

The estimation of patients which use medicinal cannabis through pharmacies in the Netherlands is about 1200. However the total amount of patients which use cannabis for medical reasons is expected to be much higher. Probably still many patients obtain cannabis through the coffeeshop / illegal circuit.

In Nederland is cannabis voor medicinaal gebruik toegestaan. Sinds september 2003 levert het Bureau voor Medicinale Cannabis (BMC) medicinale cannabis aan patiënten via apotheken. Zowel nationale als internationale wetgeving is hierbij van toepassing. 

Internationaal gezien is er het Enkelvoudig VN-Verdrag inzake verdovende middelen (1961). Artikel 28 van dit verdrag stelt dat indien een land de verbouw van cannabis toelaat dit onder toezicht van een nationaal regeringsbureau moet plaatsvinden.

In Nederland is dat het Bureau voor Medicinale Cannabis (BMC) dat onderdeel uitmaakt van het Ministerie van Volksgezondheid, Welzijn en Sport.

Op internationaal niveau houdt de International Narcotics Control Board (INCB) van de VN toezicht op de activiteiten van het BMC. 

Op nationaal niveau hebben we te maken met de Opiumwet. Het is in Nederland verboden cannabis te telen, tenzij hier een ontheffing voor is verleend.

In Nederland is er één teler met een dergelijke ontheffing voor de teelt van (medicinale) cannabis ten behoeve van levering aan apotheken.

Het BMC koopt de medicinale cannabis op van de teler en levert deze via een farmaceutische groothandel aan apotheken. Apotheken voorzien de patiënten (alleen op doktersrecept) van de medicinale cannabis. In aanvulling hierop is er gestandaardiseerde cannabis verkrijgbaar via BMC voor wetenschappelijk onderzoek en productontwikkeling. 

Rechtspraak

In oktober 2006 heeft de hoogste rechterlijke instantie in Nederland, de Hoge Raad, besloten om een patiënt die zonder ontheffing cannabis teelde, niet te bestraffen omdat uitzonderlijke omstandigheden in een individueel geval kunnen meebrengen dat verboden gedragingen gerechtvaardigd kunnen worden indien wordt gehandeld in noodtoestand.

Deze uitspraak is uniek en geldt ook alleen voor deze individuele patiënt. Deze uitspraak betekent niet dat het andere patiënten nu vrijstaat om zelf te gaan telen.  

In de praktijk

Het BMC is de leverancier van medicinale cannabis aan apotheken. Hiervoor is een hele productie- en distributieketen opgezet. Er zijn een teler en een verpakkings- en distributiebedrijf gecontracteerd. Om er zeker van te zijn dat patiënten een gestandaardiseerd, veilig en kwalitatief goed product ontvangen is zoveel mogelijk aangesloten bij de Europese GAP-Richtlijn (Good Agricutural Practices for Growth).

De gecontracteerde teler teelt volgens de eisen van deze richtlijn.

Alle batches moeten voldoen aan de kwaliteitseisen die zijn vastgesteld door het BMC. Om te garanderen dat de medicinale cannabis veilig en kwalitatief goed is, heeft het BMC een GLP-gecertificeerd laboratorium gecontracteerd. Gezamenlijk is er een monografie opgesteld die aansluit bij de eisen uit de Europese farmacopee.

Elke oogst medicinale cannabis wordt getest op (de gehaltes van) inhoudsstoffen, vochtgehalte, afbraakproducten, microbiologie, pesticiden, zware metalen en aflatoxines. Voor elke batch medicinale cannabis wordt een vrijgiftecertificaat met daarop alle relevante informatie opgemaakt. Deze zijn te downloaden via de website www.cannabisbureau.nl

Er wordt geschat dat ruim 1200 patiënten in Nederland medicinale cannabis van de apotheek gebruiken. Het totaal aantal patiënten in Nederland die cannabis op medische gronden gebruiken wordt veel hoger geschat. Vele patiënten verkrijgen de cannabis ook via de coffeeshop / het illegale circuit of door zelf te telen.
