Regarding drug laws, Cannabis is prohibited since 1925 (Geneva Convention / 1961 ONU Convention). It disappeared from the French pharmacopoeia in 1953. This status has not changed since then. Its use, importation, sell, transportation and production are strictly prohibited. Thus, Cannabis, and its Cannabinoids derivatives, are not allowed for medical use in France.

Nevertheless, since 1999, the French Security Agency for Health Products (AFSSAPS) has the authority to deliver nominative or cohort authorization ATU (Temporary Utility Authorization) for health products. ATU concerns products that are not authorized on the French market. In 2008, ATU for Cannabinoids containing products was only possible for Marinol® (dronabinol).
In 2013, the first decree authorizing medical use of cannabis and cannabinoids has been voted and published, removing the historic prohibition in France (JORF n°0130 du 7 juin 2013 page 9469 : http://www.legifrance.gouv.fr/affichTexte.do?cidTexte=JORFTEXT000027513604&dateTexte&categorieLien=id )
 

Court Rulings

In May 2001, Paris administrative court rejected a request of the MLC (Movement for Controlled Legalisation) concerning the importation of 10 Kg of cannabis to relieve pains of 10 patients suffering from incurable diseases. Rejection arguments were the incompatibility of the demand with ONU 1961 Convention and the incapacity of the MLC to scientifically and administratively control the medical use of cannabis.

In September 2002, a 50 years old patient, suffering HIV for 17 years, was condemned to 10 months prison suspended sentence for having growing 34 plants.

In 2002, Papeete (Tahiti) law court acquitted a 55 years old paraplegic patient. He was initially condemned for the growing of 350 cannabis plants. The law court based its request on the article 122-7 of the penal code which specifies: "is not guilty a person who, facing a real danger, accomplish an act in order to protect himself".
In March 2014, after a 6 years juridical procedure, the request of an Attention Deficit Hyperactivity Disorder (ADHD) patient has been rejected by Strasbourg Administrative Court. He was requesting a derogation for Bedrocan products importation in France. These products were delivered in Netherlands pharmacies under medical prescription.
In the last years, a growing number of juridical cases are raised regarding possession, use or culture of cannabis. In all cases, when the patient can justify the medical use and is supported by a doctor, judgement is in favor of the patient. The person remains guilty but no sentence is applied.
 

Realties

Since 2001, 74 nominative ATU for dronabinol have been delivered. ATU requests have doubled between 2001 and 2002.ATU for dronabinol were delivered for the following conditions:
- Pains resistant to standard treatments (41)
- Inflammatory affection of the nervous system (12)
- Unverricht-lundborg disease (8)
- Appetite, nauseas (7)
- Tourette Syndrome (3)
- Dystonia resistant to standard treatments (8)
- Paroxystic pains (1)
- Total (74)

20 ATU were refused for the following conditions:
- Pains resistant to standard treatments (12)
- Secondary spasticity due to Multiple Sclerosis (3)
- Painful spastic paraparesia (3)
- Appetite, nauseas (1)
- Chronic pains (1)

Since January 2014, Sativex® is authorized on the French market.

Les lois concernant les drogues interdisent le cannabis depuis 1925 (Convention de Genève / Convention de l'ONU 1961). Celui-ci a été retiré de la pharmacopée française depuis 1953. Sa prohibition n'a pas évoluée depuis. Son usage, importation, vente, transport et production sont strictement interdits par la loi. Ainsi, le Cannabis, ainsi que ses dérivés à base de cannabinoïdes (naturels ou de synthèse), ne sont pas autorisés pour usage médical en France.

Néanmoins depuis 2012, l'Agence Nationale de Sécurité des Médicaments ANSM), qui succède à Agence Française de Sécurité Sanitaire des Produits de Santé (AFSSPS), a autorité pour délivrer des autorisations nominatives ou de cohorte ATU (Autorisation Temporaire d'Utilisation) pour tous produits de santé. Les ATU concernent les produits de santé qui ne sont pas autorisés sur le marché français.
En 2013, le premier décret autorisant l’usage médical du cannabis et des cannabinoïdes a été voté et lève ainsi l’interdiction historique en France (JORF n°0130 du 7 juin 2013 page 9469 : http://www.legifrance.gouv.fr/affichTexte.do?cidTexte=JORFTEXT000027513604&dateTexte&categorieLien=id )

 

Jugements / Cours

En mai 1991, la cour administrative de Paris a rejeté la demande du MLC (Mouvement pour la Légalisation Contrôlée) concernant l'importation de 10 kg de cannabis pour le soulagement des douleurs de 10 patients souffrants de maladies incurables. Les arguments du refus étaient l'incompatibilité avec la convention de l'ONU de 1961 et l'impossibilité du MLC de contrôler scientifiquement et administrativement l'usage médical du cannabis.

En septembre 2002, un patient de 50 ans, atteint du SIDA depuis 17 ans, a été condamné à 10 mois de prison avec sursis pour avoir fait pousser 34 plants de cannabis.
En 2002, la cour de Papeete (Tahiti) a acquitté un patient paraplégique de 55 ans. Il avait été inculpé auparavant pour avoir fait pousser 350 plants de cannabis. La cour a basé sont jugement sur l'article 122-7 du code pénal qui spécifie : " n'est pas coupable une personne qui, face à un danger réel, accompli un acte dans le but se protéger lui-même ".
 
En mars 2014, après 6 ans de procédure, la demande d’un patient atteint de Trouble Déficit de l’Attention Hyperactivité (TDAH), a été rejetée par le Tribunal Administratif de Strasbourg. Il demandait le droit d’importation des produits Bedrocan en France. Ces produits étaient obtenus sur prescription médicale et délivrés dans des pharmacies des Pays-Bas.
Durant les dernières années, les affaires impliquant des patients se sont multipliées, soit pour possession, usage ou culture de cannabis. Dans tous les cas, les personnes qui ont pu justifier d’un usage médical, et qui ont été soutenu par leur médecin, ont toutes obtenu des dispenses de peine. Néanmoins, elles n’ont pas été acquittées, indiquant que ces personnes restent coupables selon la Loi en vigueur.

 

Réalités

En 2001 74 ATU nominatives pour le Dronabinol ont été délivrées. Le nombre de ces ATU a doublé de 2001 à 2002. Les ATU pour le Dronabinol ont été délivrées pour les conditions suivantes :
- Douleurs résistantes aux traitements standards (41)
- Affections inflammatoires du système nerveux (12)
- Maladie d'Unverricht-lundborg (8)
- Appétit / nausées (7)
- Syndrome de Tourette (3)
- Dystorie résistante aux traitements standards (8)
- Douleurs Paroxystiques (1)
- Total (74)

20 ATU ont été refusées pour les conditions suivantes :
- Douleurs résistantes aux traitements standards (12)
- Spasticité secondaire due à sclérose multiple (3)
- Para parésie spastique douloureuse (3)
- Appetit / Nausées (1)
- Douleurs chroniques (1)

Depuis janvier 2014, le Sativex® est autorisé sur le marché français.
