In 1997, our Ministry of Health issued a law that made it possible for patients to require the import of drugs registered abroad after getting a prescription. The request had to be forwarded to the Ministry, that took at least two months to grant it. With this permission, the patient, assisted by a pharmacist or by the regional health service, could be able to get the medication required, but had to pay for it. In special circumstances, the cost of the drug could be charged to the hospital or the health service . The duration of the treatment could not be longer than 3 months, and renewal could be requested only when all the drug material had been consumed, and not before.

Unsurprisingly, few patients followed this supply protocol, and the average number of application was ca. 250/year.

In 2011, the discussions started in some Regions to find a regulatory way to charge the supply of cannabis drugs to the regional health service. The first Region that approved the law on cannabis was in Tuscany (18 May 2012). Unfortunately, to implement a law, a specific implementation order is requested.

To address this issue, a committee doctors was establish.  After more than two years of discussion, a blueprint  for a regulation was established. However, it was so strict in limiting the reimbursements, that all associations of diseased people appealed for a review. Last week a meeting between the patient groups and the regional authorities took place, but it is still unclear to what extent patients will be able to qualify for reimbursement. Initially, this was possible only for cancer and multiple sclerosis patients, when other medicines did not give relief, and when the predominant symptom was muscle spasm or HIV disease problems. In practice, only for diseases for which the mainstream drugs Marinol , Cesamet , and Sativex  had been approved.

Some diseases that qualify for treatment with medicinal Cannabis in the Netherlands were not included.

In mid- 2013, Sativex has received Italian marketing authorization for hospital use, and can be prescribed by the neurologists. Patients who are not treated in the hospital and wants to buy the drug by themselves have to pay 740 euro for the amount necessary for one month treatment (three 10 mL units of the drug). In 2012, an Italian company that distributes generic products and pharmaceutical ingredients for pharmacies started the import of medicinal Cannabis from The Netherlands . In most cases, patients have to pay for these drugs, and the cost per gram often exceeds 35 €. With the start of this service, the Ministry ended up granting permission for direct import of drugs. Meanwhile, other Regions have passed laws very similar to the one approved in Tuscany. Among these are Liguria, Veneto, Friuli Venezia Giulia, and Marche. The Liguria and Veneto laws have been challenged, being held unconstitutional by the Council of Ministers. After another year, the regional laws were finally been cleared from a regulatory standpoint, although the implementing decree is still missing for all of them .

The latest Region to approve the law on medicinal Cannabis was Abruzzo, and in this case the Council of Ministers (Renzi’s Government) did not challenge the law, an act that the media have interpreted as though as no obstacle did not finally exist between medicinal cannabis and patients. However, the issue is still unclear, although it seems clear that the production of medicinal Cannabis in Italy will resume in the near future. It is, however, unclear if it will be possible to produce the whole range of products distributed by the Dutch Ministry of Health, or, rather, if  only galenic preparations formulated as traditional medicines will be allowed. The idea of distributing Cannabis identical to that recovered from the black market is adversed by  the department of drug control.

Il nostro Ministero della Salute nel 1997 aveva approvato una legge che consentiva al paziente di richiedere l’importazione dei farmaci registrati all’estero dopo aver ottenuto la prescrizione dal proprio medico. Questa richiesta doveva essere inoltrata al Ministero il quale impiegava almeno due mesi per concederla. Con questa autorizzazione il paziente, assistito da un farmacista o dal servizio sanitario regionale, riusciva ad ottenere il farmaco richiesto pagandolo personalmente.

In qualche circostanza il costo del farmaco veniva pagato dall’ospedale o dal servizio sanitario. La durata della cura non poteva essere più lunga di 3 mesi. Una volta esaurito il farmaco e non prima, la procedura poteva essere ripetuta.

Come si può capire, pochi erano i pazienti che seguivano questo percorso. Mediamente 250 richieste ogni anno.

Nel 2011 sono iniziate le prime discussioni in alcune Regioni per arrivare ad approvare una legge che prevedesse la copertura delle spese e il recupero dei farmaci della Cannabis da parte del servizio sanitario regionale. La prima Regione che ha approvato la legge sulla Cannabis è stata la Toscana (18 maggio 2012). Purtroppo per attivare una legge è necessario definire un ulteriore decreto di attuazione della legge. I funzionari della Regione, per definire il decreto, hanno nominato una commissione formata da numerosi medici e dopo più di due anni sono arrivati ad una prima proposta di regolamento che però limitava talmente i casi in cui i farmaci derivati dalla Cannabis o a base di cannabinoidi erano ottenibili che tutte le associazioni dei malati si sono appellati per una revisione. Solo la settimana scorsa c’è stato l’incontro tra le associazioni dei malati e le autorità regionali ed ancora non è ben chiaro se le possibilità per i pazienti di ottenere i farmaci senza doverli pagare sarà estesa o limitata a poche patologie. Inizialmente era possibile ottenere i farmaci solo per malati di cancro, sclerosi multipla, quando gli altri farmaci non avevano dato buoni risultati e quando il sintomo prevalente era lo spasmo muscolare e di sintomi HIV. In pratica solo per le patologie per cui era stato approvato il Marinol, Sativex e Cesamet.

Non erano comprese le malattie che in Olanda sono trattabili con la Cannabis.
A metà 2013 il Sativex ha ottenuto l’autorizzazione all’immissione in commercio e registrato nella fascia dei farmaci ad uso ospedaliero e prescrivibile dallo specialista neurologo. Il paziente che non viene trattato in ospedale e vuole acquistare il farmaco deve pagare 740 euro per 3 flaconi da 10 ml (cura per la durata di un mese). Nel 2012 un’azienda italiana che distribuisce prodotti generici o materie prime per le farmacie ha avviato l’importazione dei prodotti di Cannabis medicinale dall’Olanda. Nella maggior parte dei casi i pazienti devono pagarsi questi farmaci ed il costo al grammo supera spesso i 35 euro/grammo. Con l’avvio di questo servizio il Ministero ha interrotto la concessione di autorizzazioni per l’importazione diretta dei farmaci. Intanto altre Regioni hanno approvato leggi molto simili a quella approvata in Toscana. Tra queste ha ora una legge la  Regione Liguria, Veneto, Friuli Venezia Giulia, Marche. Le leggi della Liguria e del Veneto sono state contestate  perché ritenute incostituzionali dal Consiglio dei Ministri. Dopo un altro anno le leggi sono state definitivamente ritenute regolari, salvo piccole osservazioni, ma per tutte manca il decreto di attuazione.

Ultima Regione ad approvare la legge per la Cannabis medicinale è stata la Regione Abruzzo ed in questo caso il Consiglio dei Ministri (Governo  Renzi) non ha contestato la legge sulla Cannabis e perciò  gli organi di stampa hanno ritenuto di divulgare  la notizia che nessun ostacolo ora si pone tra la Cannabis medicinale e i pazienti, ma ancora le cose non sono chiare. Di certo è che sembra sempre più vicino il momento in cui anche nel nostro Paese si avvierà la produzione di Cannabis medicinale. Ancora però non è chiaro se sarà possibile produrre prodotti del tipo di quelli distribuiti dal Ministero della salute olandese o se invece saranno preferiti o ammessi solo estratti o preparazioni galeniche formulate come farmaci tradizionali. L’idea di distribuire Cannabis identica a quella recuperabile dal mercato nero non piace al Dipartimento delle politiche antidroga.
